These Terms and Conditions ("Terms") govern your use of the Day Planner mobile application and website (the "Service") provided by Day Planner ("we", "us", or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Day Planner Service, you confirm that you are at least 13 years of age, have read and understood these Terms, and agree to be legally bound by them. If you do not agree to these Terms, you may not use the Service.

2. Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password confidential and not share it with any third party

  • Be responsible for all activities that occur under your account

You may use the Day Planner Service for personal, non-commercial productivity purposes.

3.2 Prohibited Use

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorised access to the Service, servers, or databases
  • Reverse engineer, decompile, or disassemble the application
  • Use automated scripts, bots, or scrapers to access the Service
  • Transmit viruses, malware, or any other malicious code
  • Interfere with or disrupt the integrity or performance of the Service
  • Impersonate another person or entity
  • Upload or share content that is illegal, harmful, or infringing on third-party rights

4. Intellectual Property

The Day Planner application, including its design, code, graphics, logos, and content, is owned by Day Planner and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal purposes only. This licence does not include:

  • The right to sell, resell, or commercially exploit the Service
  • The right to copy or reproduce any part of the Service outside of normal use
  • Any rights to the Day Planner trademark, logo, or brand materials

5. Your Content

You retain ownership of all tasks, routines, notes, and other content you create within Day Planner ("Your Content"). By using the Service, you grant us a limited licence to store, sync, and display Your Content solely for the purpose of providing the Service to you. We do not claim ownership of Your Content and will not use it for any other purpose.

6. Data and Privacy

Our collection and use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of data as described in the Privacy Policy.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may temporarily suspend or restrict access to the Service for maintenance, upgrades, or other operational reasons. We will provide advance notice where reasonably possible.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, secure, or continuously available.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Day Planner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users, the Service, or third parties. You may terminate your account at any time from within the app settings.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the competent courts.
